Energy Club has sent an appeal to the Chairman of the National Commission for State Regulation of Energy and Utilities (NCRECU), Yuriy Vlasenko, regarding critical issues faced by electricity suppliers after recent legislative changes.
The basis for the appeal was a letter from LLC “ENERGETYCHNE PARTNERSTVO”, which appealed to Energy Club with a request for support in resolving problematic issues in the electricity market. The company outlined the problem of the risk of suppliers acquiring the status of “Pre-default” and “Default” due to delays in payments to the transmission system operator, especially when these delays are caused by unpaid debts from critical infrastructure facilities.
As commented on the situation Dmitry Morgun, lawyer and legal advisor to LLC “ENERGY PARTNERSHIP”, receiving funds from critical consumers is practically impossible in conditions of martial law, and the consequences for the electricity market can be catastrophic.
The problem turned out to be relevant for many market participants, so Energy Club member companies signed the appeal. The document proposes that the National Commission for the Regulation of Energy and Utilities of Ukraine, when determining the procedure for obtaining and terminating the “Pre-default” and “Default” statuses, not apply these statuses to suppliers that provide electricity to critical infrastructure facilities.

The signatories emphasize that the current situation threatens the financial stability of the energy market and may disrupt the energy supply of critical infrastructure facilities. The appeal calls for regulatory measures that balance the interests of all market participants, while ensuring the energy security of Ukraine under martial law.
