NEURC Reform: Energy Club Shapes the Market Position

Draft Law No. 14282 (dated Dec 8, 2025) “On Strengthening Guarantees for the Exercise of Powers by the NEURC,” along with the alternative Draft Law No. 14282-1 (dated Dec 22, 2025), has been registered in the Verkhovna Rada of Ukraine. The documents are currently under review by the Parliamentary Committee on Energy, Housing, and Utilities.

For the energy market, this is far from a “technical amendment.” The future model of the regulator—whether it is independent, professional, and predictable, or politically vulnerable—directly impacts corporate operations, the investment climate, and the trust of international partners. Furthermore, requirements for the independence of national regulators are strictly enshrined in EU law (specifically Directive (EU) 2019/944).

We do not intend to turn this issue into a “battle of camps” or a debate over personalities. Our goal is to formulate and convey a consolidated market position focused on:

  • Rooting out corruption and increasing public and professional trust in the Regulator;

  • Institutional capacity and the genuine independence of the NEURC.

To ensure the market’s voice is backed by solid arguments rather than emotion, we are launching several engagement formats:

  1. Surveying Member Positions: Collecting brief surveys and formal written proposals from Club members.

  2. Multisectoral Working Group: Bringing together representatives from generation, RES, DSOs, trading/supply, large consumers, and industry experts.

  3. Public Discussion Series: Live-streamed online sessions focusing on risks, safeguards, and EU best practices.

  4. Policy Paper Development: Drafting specific legislative proposals for the Parliamentary Committee and key stakeholders.

Colleagues, this is a case of “speak now, or live with the rules later.” We invite Energy Club members to take an active role: assess the risks and benefits of this initiative for your specific segment, define “red lines,” and be prepared to participate in public discussions.
