Understanding the intricacies of diversifying gas supplies in Poland: we invite you to the Energy Club meeting

09.12.2024

Energy Club announces the event “Legal Aspects of Gas Supply Diversification in Poland”, which will take place on December 16, 2024 from 15:00 to 17:00 in Warsaw.

This event will be dedicated to the complex legal issues related to the diversification of gas supplies in Poland, with a special focus on the consequences of temporary storage of gas of European origin in a customs warehouse in Ukraine.

Key issues that we will consider:

  • Origin and Status: Does gas exported from Poland and temporarily stored in Ukraine retain its status as Polish/European gas? How does this affect the implementation of diversification rules?
  • Pre-determined use: What legal impact do forward contracts and temporary storage have on the final destination of gas?
  • Excise duties: Is the re-import of gas from a bonded warehouse subject to excise duty? What are the exceptions?
  • Diversification rules: How is re-imported gas taken into account in the requirements for diversification of gas supplies in Poland (33% rule)
  • Legal framework: What EU and Polish legislation regulates temporary storage of gas and its re-import?

We will examine these issues in detail, providing clear explanations on the regulatory framework and practical aspects of gas diversification.
