Legal uncertainty regarding price changes in contracts in the field of public procurement remains one of the key threats for energy suppliers. Following the decision of the Grand Chamber of the Supreme Court dated January 24, 2024, in case No. 922/2321/22, which limited price increases to 10% for the entire duration of the contract, market participants faced numerous lawsuits. This creates serious risks for suppliers and may threaten the stability of energy supply to budget institutions.
In the context of the expected decision in case No. 920/19/24, which is currently under consideration by the Grand Chamber of the Supreme Court, there arose a need for in-depth legal analysis of the situation. In connection with this, on the initiative of “Ukr Gas Resource” company and with the support of Energy Club, work was started on a comprehensive scientific and legal expertise at the V.M. Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine.
The purpose of the expertise is to obtain authoritative and scientifically substantiated answers to the most pressing legal questions, which will allow developing a unified industry position and ensuring effective protection of suppliers’ interests in courts.
