The team of lawyers «FEDOTOV&PARTNERS» successfully protected the interests of the client – an electricity trader, thanks to which the court recognized the resolution of the National Commission for State Regulation in the Spheres of Energy and Utilities (NKREKP) as unlawful and canceled it (Case No. 640/38180/21).
Case circumstances: The NCREKP issued a resolution imposing a fine on the trader for violating the requirements of regulatory legal acts regulating the electricity market. The trader, considering the Resolution unfounded, appealed to the Law Office “Fedotov and Partners” in order to protect his rights. The lawyers conducted a detailed analysis of the documents, the results of which established the grounds for appealing to the court.
Court decision: The Sixth Administrative Court of Appeal, having examined the appeal and the case materials, concluded that the resolution of the National Commission for the Regulation of Energy and Power Generation does not meet the requirements of the legislation. Thus, the Court of Appeal granted the trader’s appeal, declared it unlawful and canceled the resolution of the National Commission for the Regulation of Energy and Power Generation.
This case became an important precedent that confirmed that the resolutions of the National Commission for the Regulation of Energy and Power Generation can be successfully canceled in court, which provides energy market participants with the opportunity to protect their interests in the legal field.
