This document provides a detailed legal and economic analysis of the crisis situation that has developed in the energy sector. The actions of certain prosecution bodies, based on the selective application of legal norms, are creating a systemic threat to the stability of the entire electricity market under martial law.
As a reminder, Energy Club initiated this collective appeal due to systemic pressure from prosecution bodies on electricity suppliers. The prosecutor’s office is actively filing lawsuits and initiating criminal proceedings, accusing companies of violating the 10% price change barrier (under the Law “On Public Procurement”). However, as Energy Club emphasizes, these actions ignore market realities and special martial law legislation (specifically CMU Resolution No. 1178), which removed this restriction for electricity, thereby creating a legal conflict and a threat to energy security.
