Energy Club has received an official response from the Office of the President of Ukraine to its appeal dated February 10, 2026, regarding the critical situation in the public electricity procurement market. As a reminder, the business community previously raised the alarm due to shifts in judicial practice and mass lawsuits filed by the prosecutor’s office against electricity suppliers, demanding the reimbursement of funds under contracts from 2018–2025. Energy Club warned that retrospective punishment of businesses for objective market price increases is forcing suppliers to refuse service to hospitals, water utilities, and other budgetary institutions, posing a direct threat to the state’s energy security.
In a letter signed by the Deputy Head of the Office of the President of Ukraine, Viktor Mykyta, it is noted that the appeal from the Public Organization “Energy Club” regarding retrospective law enforcement in the field of public electricity procurement has been reviewed.
To resolve this problem, the Office of the President has officially involved the Government:
“The Cabinet of Ministers of Ukraine has been requested to process the raised issues, take appropriate response measures, and inform you of the results,” the official response addressed to Energy Club President Andrii Kostrytsia states.
The reaction of the Office of the President and the transfer of this issue to the level of the Cabinet of Ministers is an important step toward stopping the destructive processes in the market. Indeed, it is the Government that possesses the authority and tools for clear regulatory settlement of price change mechanisms in contracts and the protection of formula-based pricing mechanisms.
The Energy Club business community continues to monitor the situation. We expect constructive and urgent steps from the Cabinet of Ministers of Ukraine that will allow honest suppliers to continue the stable provision of critical infrastructure without fear of retrospective criminal or financial prosecution.
