The “Energy Club” has sent an official appeal to Artem Nekrasov, the Head of the Auction Committee for the sale of electricity under bilateral contracts and the First Deputy Minister of Energy of Ukraine. The letter requests the initiation of amendments to the Regulations for conducting electronic auctions due to the crisis situation in the electricity market.
As stated in the appeal, the abnormal price drop in the “day-ahead” market (DAM) at the beginning of September has led to a situation where many conscientious companies are objectively unable to fulfill their obligations under bilateral contracts concluded at auctions.
The market participants who entered into these contracts acted in good faith, relying on stable and predictable rules. However, the current situation, which shows signs of atypical market conditions and is already being investigated by the NEURC for possible abuses, puts these companies at risk of devastating penalties. This could lead to a deterioration of their financial condition and even bankruptcy.
Considering these circumstances, the Energy Club has appealed to the Auction Committee to initiate a meeting to address a key issue: amending the Regulations to suspend the application of penalties for non-fulfillment of obligations under bilateral contracts until the official conclusions of the NEURC investigation are received.
“Such a step will protect conscientious market participants from devastating financial consequences and will demonstrate a balanced approach to regulation in crisis conditions,” reads the letter signed by the President of the Energy Club, Andrii Kostrytsia.
