Euro Trade Energy LLC, a member of the club, approached Energy Club requesting public coverage of a legal issue that has become particularly relevant today.
This concerns the ruling of the Grand Chamber of the Supreme Court dated January 24, 2024, in case No. 922/2321/22, which significantly affected contractual relations in the public procurement of electricity.
According to the Court’s position, the total price increase for goods under a procurement contract cannot exceed 10%, regardless of the number or timing of changes throughout the entire contract period.
This creates significant risks for the stable energy supply of the public sector, especially under martial law and sharp price fluctuations in the electricity market. As of today, the Commercial Cassation Court, in a case with similar circumstances, recognized the existence of an exclusive legal problem and, by its ruling of January 29, 2025, in case No. 920/19/24, referred it to the Grand Chamber of the Supreme Court to establish uniform legal practice.
This week, Energy Club is organizing an online meeting dedicated to this important issue to prepare a collective appeal from Energy Club member companies to the Verkhovna Rada of Ukraine Committees on Legal Policy and on Energy, Housing and Utilities Services.
