How businesses can influence the rules of the game in the energy sector: key insights from Olga Babiy's lecture

As part of the Energy Club training course “Communications and Interaction in Energy: Strategies for PR, Marketing, GR and Lobbying in Ukraine”, a lecture was given by Olga Babiy, a member of the National Commission for the Regulation of Energy and the Energy Sector in 2019-2024 and an advisor to the Chairman of the National Security and Defense Council. The expert shared her unique experience and exclusive information about the regulatory environment of Ukraine’s energy markets.

During the lecture, Olga Babiy, drawing on her own experience working at the National Commission for the Regulation of Energy and Power Generation, explained in detail to the audience at which levels of legislation key issues in the energy sector are regulated. She presented an overview of the main regulatory legal acts, in particular the Law of Ukraine “On the Electricity Market” and the Law of Ukraine “On the Natural Gas Market”, which are the foundation for the functioning of competitive markets and the protection of consumer interests.

Course participants learned about the distribution of powers in energy markets between state authorities, such as the Verkhovna Rada, the Cabinet of Ministers and the Ministry of Energy, as well as the regulator (NEC “Ukrenergo” and LLC “GTS Operator of Ukraine”).

The lecturer paid special attention to the practical aspects of interaction with the regulator. Ms. Olga explained how decisions are made at each level and how market participants can effectively use their advocacy capabilities. The procedure for initiating changes to regulatory acts was considered in detail, which includes the preparation of a substantiated proposal based on analytical data, attracting stakeholder support and supporting the project at all stages of discussion.

International regulatory frameworks were also considered, in particular EU Directives 2009/72/EC and 2009/73/EC, which define common rules for the internal electricity and natural gas markets in the Community.

Olga Babiy provided practical advice on how to track rapid changes in regulatory legislation, especially in conditions of martial law, and on which resources to find relevant documentation for use in your activities.

The lecture became an important part of the course “Communications and Interaction in Energy”, which is designed to strengthen the communication capabilities of companies, promote their competitiveness, and support the sustainable development of the energy sector of Ukraine.
