Energy Security Under Threat: Energy Club Holds Expert Discussion on Public Procurement Crisis

On May 11, 2026, Kyiv hosted the forum “Public Procurement of Electricity: Legal Certainty, Retrospective Risks, and Energy Security,” organized by the business community Energy Club.

The central theme of the forum was the critical situation arising from changes in judicial practice and mass prosecutorial challenges to supplementary agreements. Market participants stated that businesses are facing threats for actions that fully complied with the legislation in force at the time.

Key discussion points:

  • Retrospective risks: The forum moderator and Vice President of Energy Club, Artem Martyniuk, emphasized that a “distrust in the predictability of state rules” has emerged in the market. He stressed that businesses cannot operate when yesterday’s legal actions are viewed as unlawful today.
  • Energy security: Viktoriya Hryb, Chair of the Verkhovna Rada Subcommittee on Energy Security, noted that this is a matter of national security. If energy companies withdraw from public procurement due to these risks, strategic facilities (hospitals, schools) may be left without supply.
  • Legislative initiatives: Mykhailo Mokhnia, representing the Ministry of Economy, spoke about the work on a new draft law to adapt European directives, while Yevhen Yakubovskyi, Director of the SE “Professional Procurement,” highlighted the decline in competition at tenders.

The professional discussion featured business representatives Oleksandr Kudym (Euro Trade Energy), Khrystyna Yan (ENERGO RESOURCE), Oleksandr Onyshchenko (D.Solutions), and leading lawyers: Oleksii Hnatenko (Juscutum), Olesia Serebryanyk, and Vitalii Bulat (FEDOTOV & PARTNERS).

The event’s co-moderator and expert in energy project development, Iryna Dmytrotsa, summarized the discussion alongside colleagues and led the official part of the forum.

The event concluded with the awarding of certificates to the graduates of the online course “Communications and Engagement in the Energy Sector.” Certificates were presented to Kseniia Lukianets, Iryna Kasianenko, Iryna Cheban, and Marian Vasylyshyn.

Energy Club continues to advocate for the creation of transparent and sustainable rules of the game to protect Ukrainian energy.
